1. Who we are

These Terms govern your use of our website, store and services (“Services”). By using the Services, you agree to these Terms and our Privacy Policy. Nothing in these Terms affects your mandatory consumer rights under EU and Belgian law.
2. Accounts & access
You must be 18+ (or age of majority) to place orders. Keep your credentials secure; you’re responsible for activity under your account.
3. Products & descriptions
We strive to accurately describe and depict products; minor variations (e.g., color due to display settings or materials) may occur. We may change descriptions, prices, and availability without notice, and may limit quantities.
4. Prices, taxes & promotions
Consumer prices are shown clearly as the total selling price; where applicable this includes VAT. Any delivery costs or optional services are displayed before checkout. If we show a price reduction, it follows EU rules on prior-price indication. Promotions may have additional terms.
5. Orders & contract formation
Your order is an offer to buy. A binding contract forms only when we email an order confirmation. We deliver without undue delay and within 30 days unless otherwise agreed. The order button is labelled to indicate an obligation to pay.
If we cannot accept or must cancel your order (e.g., stock, pricing error, suspected fraud), we’ll notify you and refund any amounts paid.
6. Shipping, delivery & risk
Delivery times shown are estimates. Risk transfers to you only when you (or a person you designate, other than the carrier) physically receive the goods. If you choose your own carrier (not offered by us), risk transfers when we hand the goods to that carrier.
Belgium: we offer at least two delivery methods for deliveries to Belgian addresses (e.g., home delivery and out-of-home/parcel point), subject to limited legal exceptions.
7. Right of withdrawal (consumers) — 14 days
If you purchase as a consumer, you have 14 calendar days from receipt of the goods to withdraw without giving a reason. To exercise, email us at hello@eyesonlystudios.com with your order details (you may use the model form below). After you notify us, you must send back the goods within 14 days.
Refunds: we refund all payments received from you, including the standard delivery cost (supplements for express options are not refunded), within 14 days of your withdrawal notice. We may withhold the refund until we receive the goods or you provide proof of return.
Return shipping costs: you pay the return shipping, unless the return is due to our error (e.g., faulty, damaged, or not as ordered), in which case we cover it.
Handling & packaging: you may handle the goods only as necessary to establish their nature, characteristics and functioning. We may deduct any loss in value caused by handling beyond that. Please return items in their original packaging where reasonably possible; not having the original packaging will not deprive you of your right of withdrawal.
Exceptions: statutory exceptions (e.g., custom-made items, sealed goods not suitable for return for health/hygiene once unsealed, digital content once performance begins with your consent) apply. We currently do not offer custom/personalised goods.

8. Legal guarantee of conformity (consumers)
Our products are covered by the statutory legal guarantee for 2 years from delivery. If a lack of conformity appears, notify us as soon as possible (you have at least 2 months from discovery to do so). We will repair or replace the item within a reasonable time and without significant inconvenience. If repair/replacement is impossible or disproportionate, you may request a price reduction or a refund (rescission). (For second-hand goods, the guarantee may be limited to 1 year if clearly stated at purchase.)
9. Payment & billing
Provide accurate billing/shipping details and use authorised payment methods. Some payments may require Strong Customer Authentication (SCA). We may cancel orders where payment is not authorised or appears fraudulent.
10. Shopify
Our store is powered by Shopify. Your contract is with EYES ONLY STUDIOS BV; Shopify is not a party to your purchase.
11. Intellectual property
All content (designs, images, text, trademarks, etc.) is owned by us or our licensors. Use is limited to personal, non-commercial purposes. Do not reproduce or distribute without permission.
12. Reviews & feedback
If you submit reviews or other feedback, you grant us a licence to use them for operating and improving the Services, where permitted by law. We do not label reviews as “verified purchaser” and we do not solicit or publish fake reviews. Where incentives are offered, we disclose this.
13. Prohibited uses
No unlawful content/activity, malware, scraping, impersonation, or spam. We may suspend or terminate accounts for misuse (without prejudice to your statutory rights).
14. Liability
We do not exclude or limit liability where it would be unlawful (e.g., for death/personal injury caused by negligence, fraud, or your mandatory consumer rights—including the legal guarantee). Otherwise, and only as permitted by law, we are not liable for indirect or consequential losses.
15. Privacy & cookies
We process personal data as controller under our Privacy Policy [link]. Shopify also processes data to provide the platform; see Shopify’s privacy notices. See our Cookie Policy [link] for cookie use and choices.
16. Complaints & out-of-court resolution

Note: the EU Online Dispute Resolution (ODR) platform has been decommissioned.
17. Governing law & jurisdiction
Consumers: Belgian law applies without prejudice to the mandatory protections of your country of residence. You may bring proceedings in the courts of your domicile or in Belgium; we may sue you only in the courts of your domicile.
Business customers (B2B): Belgian law applies; the courts of Antwerp have exclusive jurisdiction.
18. Changes to these Terms
We may update these Terms for legal, technical or business reasons. If changes are material, we will give notice as required by law. Your continued use after the effective date constitutes acceptance.
